Terms of Service

1. Acceptance of Terms

By accessing or using Red Orca (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including free and paid accounts.

2. Description of Service

Red Orca builds AI software: Dolphin (AI voice sales agent — automated phone calls, lead qualification and sales rep handoffs), Oyster (a free security AI assistant, see §5) and Shark (an organizational-memory assistant, currently offered as a browser-local preview and as paid deployments arranged directly with us). The Service is provided “as is” and may be updated or changed at any time.

3. User Responsibilities

  • You are solely responsible for complying with all applicable laws when using AI calling features, including GDPR, TCPA, and local telemarketing regulations.
  • You must obtain appropriate consent from call recipients where required by law.
  • You must not use the Service to send unsolicited communications, engage in fraud, or harass individuals.
  • You must keep your account credentials secure and notify us immediately of any unauthorized access.
  • You must not attempt to reverse engineer, decompile, or interfere with the Service.

4. Acceptable Use

The Service may only be used for lawful business purposes. Prohibited uses include:

  • Contacting numbers on national or regional Do Not Call registries without prior express consent
  • Impersonating individuals, companies, or government entities
  • Conducting scam calls, phishing, or any form of fraud
  • Calling minors without parental consent
  • Using the Service in jurisdictions where automated calling is prohibited

5. Oyster — Free Security AI Assistant

Oyster is provided free of charge, as is, with no uptime or accuracy guarantee. Its answers can be wrong and must not be relied on as professional security advice. You are responsible for what you do with them.

You may only use Oyster to assist with testing systems you are authorised to test. Using it to plan or support unauthorised access to systems you do not own or have written permission to test is a breach of these Terms and may be a criminal offence in your jurisdiction.

Conversations and AI training.If you create an account, your conversations are stored to your account and may be used by Red Orca to evaluate and train Oyster's AI models. Accepting this is a condition of using the free tier — it is not optional, and Oyster will not allow you to chat until you have accepted the current agreement. You may withdraw at any time from Settings; withdrawing excludes your conversations from every dataset built afterwards and also ends your chat access, since acceptance is what grants it. Models already trained cannot be untrained. See the Privacy Policy §6 for the full detail.

Without an account, Oyster gives you a small daily allowance. Those conversations are not stored on our servers and are never used for training.

Do not submit secrets. Do not paste credentials, API keys, personal data about other people, or client-confidential material into Oyster. Exchanges that appear to contain secrets are discarded before training, but no automated scan catches everything.

Fair use: daily limits apply to messages and uploads. Automated scraping, resale of access, or attempts to overload the service are prohibited and may result in a block without notice.

6. Billing & Subscriptions

Paid plans are billed monthly or annually. All fees are non-refundable except where required by law. You may cancel your subscription at any time; access continues until the end of the billing period. Overage charges for call minutes above your plan's included amount are billed at the per-minute rate listed on the pricing page. All prices are in EUR and exclude applicable taxes, which are added at checkout based on your location.

7. Free Demo

You can try Red Orca before paying: the site includes a free demo that needs no payment details. Running real campaigns — placing live calls or sending email — requires an active paid plan. We do not currently offer a free trial of the paid plans, and no charge is ever made without you choosing a plan first.

8. Intellectual Property

Red Orca retains all rights, title, and interest in the Service, including all software, AI models, and branding. You retain ownership of your data (leads, call recordings, transcripts, and your Oyster conversations).

You grant Red Orca a limited licence to process your data to provide the Service. For Oyster accounts only, that licence extends to using your conversations to evaluate and train Oyster's AI models, as set out in §5 — this is the exception, and it does not apply to Dolphin call recordings, transcripts or lead data, which are never used to train AI models. Ownership stays with you either way, and a model trained on data does not transfer ownership of that data.

9. Limitation of Liability

To the maximum extent permitted by law, Red Orca shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service, including fines, penalties, or legal costs resulting from your failure to comply with applicable calling laws. Our total liability shall not exceed the amount you paid in the 3 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms. Upon termination, your access to the Service ends immediately. You may request an export of your data within 30 days of termination.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, unless local mandatory law provides otherwise.
